Please read these Terms of Service carefully before using PayEchallan. By accessing or using our platform — whether via web or mobile — you agree to be bound by these terms. If you do not agree, please discontinue use of the platform immediately.

Binding Agreement

These Terms constitute a legally binding agreement between you and PayEchallan. Using this platform means you have read, understood, and agreed to all the terms listed below.

1. About PayEchallan

Platform Overview: PayEchallan is an independent digital platform that enables users to check vehicle RC details, verify pending traffic challans, and make challan payments through official government-connected APIs.
Not a Government Entity: PayEchallan is not affiliated with, endorsed by, or part of any government body, RTO office, or traffic authority. We are a private technology platform operating within the legal framework of India.
Jurisdiction: These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.

2. User Eligibility & Account

Age Requirement: You must be at least 18 years of age to use PayEchallan. By using this platform, you confirm that you meet this requirement.
Account Registration: To access certain features like payment history and saved records, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account.
Accurate Information: You agree to provide accurate, current, and complete information when using the platform. Providing false or misleading information may result in account suspension.
Account Security: You are solely responsible for all activities that occur under your account. Notify us immediately at support@payechallan.com if you suspect unauthorized access.

3. Permitted Use

Personal Use Only: This platform is intended for personal, non-commercial use only. You may use PayEchallan to check and pay your own vehicle's challans or challans of vehicles you are legally authorized to manage.
Lawful Purpose: You agree to use PayEchallan only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the platform.
Compliance: You agree to comply with all applicable laws, regulations, and government directives while using our services, including the Information Technology Act, 2000 and its amendments.

4. Prohibited Activities

No Fraudulent Use: You must not use the platform to submit false information, make fraudulent payments, or impersonate any person or entity.
No Scraping or Automation: Automated scraping, crawling, data harvesting, or use of bots on our platform without written permission is strictly prohibited.
No Reverse Engineering: You must not attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of our platform or APIs.
No Harmful Content: Uploading, transmitting, or distributing any malicious code, viruses, or content that may harm our systems or other users is strictly prohibited.
No Unauthorized Commercial Use: Reselling, sublicensing, or using our platform or its data for commercial purposes without prior written consent from PayEchallan is not permitted.

5. Payments & Transactions

Payment Processing: All payments are processed through RBI-approved, PCI-DSS compliant payment gateways. PayEchallan does not store your card number, CVV, or banking credentials.
Platform Fee: PayEchallan charges a small convenience/platform fee in addition to the challan amount. This fee is non-refundable and covers technology, gateway, and operational costs.
Payment Accuracy: You are responsible for entering the correct vehicle number and challan details before confirming payment. PayEchallan is not liable for payments made against incorrect information entered by the user.
Processing Time: After a successful payment, the challan status on the official government portal may take 1 to 7 business days to reflect as 'Paid'. This is a government-side processing delay and is outside our control.
Failed Transactions: In case of a failed transaction where money is debited from your account, the amount will typically be reversed within 5–7 business days by your bank or payment gateway automatically.

6. Data & Privacy

Data Collection: By using PayEchallan, you consent to the collection and use of your information as described in our Privacy Policy.
Government Data: Vehicle and challan data is fetched in real-time from official government databases. We do not modify, alter, or fabricate any government data shown on our platform.
Data Accuracy: While we strive for accuracy, PayEchallan is not responsible for errors or inaccuracies in the data provided by government APIs or third-party sources.

7. Disclaimers & Limitations

No Warranty: PayEchallan is provided on an 'as-is' and 'as-available' basis without any warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
Service Availability: We do not guarantee that the platform will be available 100% of the time. Maintenance, upgrades, or factors beyond our control may cause temporary downtime.
Government Portal Delays: PayEchallan is not responsible for delays in challan status updates caused by government portals, RTO systems, or traffic authority servers.
Limitation of Liability: To the maximum extent permitted by law, PayEchallan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform.

8. Intellectual Property

Our Content: All content on PayEchallan — including but not limited to the logo, design, text, graphics, and code — is the intellectual property of PayEchallan and is protected under applicable copyright and trademark laws.
Restricted Use: You may not copy, reproduce, distribute, modify, or create derivative works of any part of our platform without our prior written permission.
User Content: By submitting any content or data through our platform, you grant PayEchallan a non-exclusive, royalty-free license to use such content solely for the purpose of providing our services.

9. Third-Party Services

Government APIs: We integrate with official government RTO/Parivahan APIs to fetch vehicle and challan data. We are not responsible for the accuracy, availability, or policies of these external systems.
Payment Gateways: Payment processing is handled by third-party gateways (e.g., Razorpay). Their terms and privacy policies apply to all transactions. We are not liable for issues arising from payment gateway failures.
External Links: Our platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any external sites.

10. Modifications & Termination

Changes to Terms: PayEchallan reserves the right to update or modify these Terms of Service at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
Notification: We will notify registered users of significant changes via email or a prominent notice on the platform. It is your responsibility to review the Terms periodically.
Account Termination: We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or misuse our platform.
Effect of Termination: Upon termination, your right to use the platform immediately ceases. All provisions that by their nature should survive termination shall survive, including ownership provisions, disclaimers, and limitations of liability.

Governing Law & Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute, claim, or controversy arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Surat, Gujarat, India. We encourage users to first contact our support team to resolve any issues amicably before seeking legal remedies.
